¿Sabías que el principal motivo por cual existen los días feriados es para que el trabajador pueda celebrar, con total libertad, las festividades, cívicas o religiosas, que se conmemoren?, pero ¿Qué sucede si te toca trabajar en esas fechas? A continuación, te contamos todo al respecto.

 

Días feriados … ¿Cuándo?

 

El artículo 74 de la Ley Federal del Trabajo (LFT), establece como días de descanso obligatorio o días feriados, en México, los siguientes:

 

  1. El 1ro de enero
  2. El primer lunes de febrero en conmemoración del 5 de febrero
  3. El tercer lunes de marzo en conmemoración del 21 de marzo
  4. El 1o. de mayo
  5. El 16 de septiembre
  6. El tercer lunes de noviembre en conmemoración del 20 de noviembre
  7. El 1o. de diciembre de cada seis años, cuando corresponda a la transmisión del Poder Ejecutivo Federal
  8. El 25 de diciembre
  9. Y el que determinen las leyes federales y locales electorales, en el caso de elecciones ordinarias, para efectuar la jornada electoral.

 

Sin embargo, existen otras fechas de asueto que no corresponden a un descanso obligatorio a nivel nacional, pero sí lo son para maestros y estudiantes, como: Semana Santa, día del maestro, entre otros.

 

Aunque en muchas empresas del país se ha hecho una tradición otorgar de descanso los días correspondientes al jueves y viernes Santo, es importante señalar que estos no han sido establecidos como días feriados en la LFT, así que lamentablemente si te toca trabajar en esas fechas el empleador no tiene la obligación de otorgar un pago extra, pues no se está cometiendo ninguna falta.

5 puntos importantes sobre los días de descanso

 

Es posible que al enterarte de que los días Santos no son de descanso obligatorio entristecieras, pero no todo es malo ya que durante el resto del año cuentas con una interesante cantidad de días feriados y otros de descanso, pues de acuerdo con la LFT:

 

  1. Todo empleado tiene derecho a un día de descanso por cada seis días de trabajo, además de los días feriados.

 

  1. Si se trabaja en un día de descanso obligatorio, se debe pagar al doble independientemente de su salario. Por ejemplo, si el trabajador gana 100 pesos diarios se le pagarán los 100 pesos, pero recibirá 200 adicionales, lo que da un total de 300 pesos (Art. 75 LFT).

 

  1. El trabajador no tiene obligación de trabajar los días de descanso, salvo que el patrón y trabajador lo acuerde. En ese caso, deberá ser remunerado como se describe con anterioridad.

 

  1. Si se labora los domingos, la empresa o patrón debe pagar ese día, con un 25% adicional como mínimo (prima dominical).

 

  1. Al cumplir un año de labor interrumpida todo empleado tiene derecho a vacaciones y recibir el pago correspondiente a la prima vacacional.
